Terms of Service
Plain-language terms for using the Daylta app and this website.
1. Agreement
By installing or using Daylta (the "app") or daylta.com (the "site"), you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the app. "We", "us" and "Daylta" refer to BigPiq.
2. What Daylta is
Daylta is a personal planning and habit app. It helps you schedule tasks, time them, build habits, and review how your day went.
3. Who can use it
You must be at least 13 years old to use Daylta. If you are under the age of digital consent where you live, you confirm that a parent or guardian has agreed to these terms on your behalf.
4. Your data and your responsibility
Daylta stores your data on your device and does not keep a copy on our servers. That means you are responsible for your data: keep your device secure and understand that uninstalling the app, resetting the device, or clearing app storage deletes your Daylta data permanently. We are not able to recover it.
5. Health information disclaimer
Daylta is not a medical device and does not provide medical advice, diagnosis or treatment. Habit logs, streaks and any suggestions from the app are for general information and motivation only. Always consult a qualified health professional before changing your exercise, diet or sleep routine, and never ignore professional advice because of something you saw in the app. See the full health disclaimer.
6. Third-party services
Google Play is provided by Google and governed by Google's own terms and privacy policies. We are not responsible for that service or for any changes Google makes to it.
7. Acceptable use
Use Daylta only for lawful purposes. Don't reverse-engineer, tamper with, or attempt to extract the app's source code beyond what open-source licences and applicable law allow, and don't use the app in any way that could damage or impair it for others.
8. Intellectual property
The Daylta name, the Bitsy character, the app design and all content we created are owned by BigPiq and protected by copyright and trademark law. Daylta is built on open-source software whose licences are listed inside the app under Settings → About → Licences; those components remain under their own licences.
You keep all rights to the content you enter into the app. Because it stays on your device, we never receive it.
9. Updates and availability
We may update the app to add, change or remove features, and we may stop offering it altogether. We will try to give notice of major changes inside the app or on this site. Some features may depend on your Android version or device.
10. No warranty
Daylta is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not guarantee the app will be error-free, uninterrupted, or that timers and reminders will fire in every circumstance (some phones aggressively stop background apps).
11. Limitation of liability
To the fullest extent permitted by law, BigPiq will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, arising from your use of, or inability to use, the app or the site. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or your statutory consumer rights.
12. Ending things
You can stop using Daylta at any time by uninstalling it. We may suspend or end your access to the app or site if you breach these terms.
13. Changes to these terms
We may update these terms. The effective date at the top will change, and for material changes we will notify you inside the app before they apply. Continuing to use Daylta after that means you accept the new terms.
14. Governing law
These terms are governed by the laws of India, and any dispute will be handled by the courts there, without affecting mandatory consumer-protection rights you have where you live.
